On liability for evasion of military registration and conscription measures

In connection with the entry into force of Decree of the President of the Republic of Belarus
of February 23, 2026 No. 67 "On Dismissal to the Reserve and Conscription for Compulsory Military Service, Service in the Reserve", the Verkhnedvinsk District Prosecutor's Office reminds
of the responsibility for evading military registration and conscription measures for military service.

According to Article 57 of the Constitution of the Republic of Belarus, the defense of the Republic of Belarus is the duty and sacred obligation of a citizen of the Republic of Belarus.

In order to ensure military registration, citizens are obliged to appear
at the time and place specified by the summons (call-up notice) of the military commissariat
at their place of residence or other body responsible for military registration.

Citizens who fail to appear without valid reasons at the place and time specified in the call-up notices or directions of the military commissariat, who have violated their military registration obligations, who evade conscription measures for military service, or who evade attending training camps or classes and training exercises, or who evade military registration, or who have refused to accept call-up notices or directions from the military commissariat, shall be held liable in accordance with
the legislative acts of the Republic of Belarus.

In case of citizens evading conscription for compulsory military service, service in the reserve, the district conscription commission shall decide
on forwarding the relevant materials to the territorial internal affairs bodies at the place of residence of these citizens for a decision
on bringing them to justice in accordance with the legislative acts of the Republic of Belarus.

Article 26.1. Failure to appear for conscription measures

Failure to appear without valid reasons for conscription measures for military service by call-up notice or direction of the military commissariat (including the failure to appear of a citizen who has refused to accept such a call-up notice or direction) or within the deadlines established by law, and during mobilization and (or) wartime - including when notified by SMS message, if such failure to appear did not prevent the adoption and (or) implementation of the decision of the conscription commission (military commissar), the head of the state security body on the fulfillment by the citizen of military duty, - entails a fine of ten to thirty basic units.

Article 26.2. Failure to notify citizens of their summons to the military commissariat

1. Failure by an official to notify citizens of a summons to a military commissariat (separate subdivision of a military commissariat), a state security body, or another body carrying out military registration, or failure to ensure their timely appearance upon summons by a military commissariat (separate subdivision of a military commissariat), a state security body, or another body carrying out military registration, or to a collection point (notification and collection point), or to a military unit, shall entail a fine of up to twenty base amounts.

2. The same acts committed repeatedly within one year after the imposition of an administrative penalty for similar offenses shall entail a fine of twenty to thirty base amounts.

Article 26.3. Violation of duties on military registration

1. Violation by citizens of duties on military registration shall entail a fine of up to twenty-five base amounts.

2. Violation by an official of duties on military registration or obstruction of citizens in fulfilling duties on military registration shall entail a fine of up to thirty base amounts.

Article 434. Evasion of mobilization military service call-up measures

Evasion of mobilization military service call-up measures shall be punishable by imprisonment for a term of two to seven years.

Article 435. Evasion of military service call-up measures

1. Evasion of military service call-up measures shall be punishable by community service, or arrest, or restriction of liberty for up to three years, or imprisonment for the same term.

2. Evasion of military service call-up measures committed by intentional self-infliction of bodily harm, or simulation of illness, or forgery of documents, or other deception, shall be punishable by restriction of liberty for up to five years or imprisonment for the same term.

Article 436. Evasion by a reservist or a person liable for military service of attendance at training sessions (classes)

1. Evasion by a reservist or a person liable for military service of attendance at training sessions (classes) shall be punishable by community service, or a fine, or correctional labor for up to one year, or arrest.

2. Evasion by a reservist or a person liable for military service of attending training sessions (classes), committed by intentionally causing bodily harm to oneself, simulating illness, forging documents, or other deception, shall be punishable by a fine, arrest, or restriction of liberty for up to two years.

Article 437. Evasion by a conscript or a person liable for military service of military registration

Evasion by a conscript or a person liable for military service of military registration shall be punishable by community service, a fine, or arrest.

For your information, in 2025, the Verkhnedvinsk District Court considered 5 criminal cases under Part 1 of Article 435 of the Criminal Code (evasion of conscription measures for military service).
