Exercising supervision over the implementation of legislation on citizens' and legal entities' appeals
Processing citizens' and legal entities' appeals is one of the key areas for any government body. The completeness and comprehensiveness of appeal review influence the restoration of violated rights of citizens and legal entities.
During the analyzed period, the state of legality in handling appeals was highlighted for local authorities in informational notes on the state of legality and law and order for 2021 and the first half of 2022.
On March 18, 2022, the Verkhnedvinsk District Executive Committee meeting addressed the issue of handling citizens' and legal entities' appeals for 2021 and the implementation of Directive of the President of the Republic of Belarus No. 2 of December 27, 2006 "On Debureaucratization of the State Apparatus and Improving the Quality of Public Services."
During the analyzed period, the district prosecutor's office conducted 2 inspections of compliance with legislation on appeals (Verkhnedvinsk State Utility Unitary Enterprise of Housing and Communal Services and the Department of Internal Affairs of the Verkhnedvinsk District Executive Committee), issued 2 submissions, and 8 officials were disciplined based on prosecutorial oversight acts.
In 2022, the district prosecutor's office received 71 appeals from citizens, of which 31 were resolved directly, 24 were forwarded to other bodies, 5 were returned, and 11 were left without substantive review.
6 appeals, or 19.4% of the reviewed citizen appeals, were fully satisfied and concerned issues of compliance with laws on minors, inquiry and investigation, and filing lawsuits (applications) in court.
3 appeals, or 9.7% of the reviewed citizen appeals, were partially satisfied and concerned issues of enforcing legislation on administrative offenses, inquiry, and filing lawsuits (applications) in court.
In 2022, the district prosecutor's office received 13 appeals from legal entities, of which 11 were resolved directly.
6 appeals, or 54.5% of the reviewed legal entity appeals, were fully satisfied, all concerning the filing of lawsuits (applications) in court.
Appeals from legal entities were not partially satisfied.
Of all the appeals from citizens and legal entities that were resolved, 11 appeals concerned issues of supervision over the enforcement of legislation (3 – on administrative liability, 2 – on issues of compliance with laws on minors, 1 – on the organization of work with citizens' appeals, 5 – on sending claims (applications) to the economic court, 1 – on issues of supervision over the legality of court decisions in criminal cases, 9 – on issues of supervision over the legality of court decisions in civil cases, 1 – on other issues).
20 appeals were resolved regarding investigation and inquiry matters, including 12 – on the actions of inquiry bodies, 8 – on the actions of investigators of the Verkhnedvinsk District Department of the Investigative Committee.
The district prosecutor's office provides personal reception of citizens and representatives of legal entities on established days and hours. The schedule for receiving individuals and legal entities at the district prosecutor's office is posted on the official website of the Verkhnedvinsk District Executive Committee and on the information board in the prosecutor's office.
115 individuals were received in person, of which 58 were received by the district prosecutor personally, who conducts such receptions every Wednesday.
During the analyzed period, 12 outreach receptions were conducted, and 48 individuals were received at their place of residence and work.
There were no instances of appeals from personal receptions being satisfied, as the appeals were mainly of a consultative nature. When conducting general supervisory inspections at enterprises, citizens' receptions were mandatorily organized.
The population is continuously informed through the newspaper "Dzvinskaya Pravda" about the place and date of receptions by prosecutor's office employees with citizens at their place of residence and work.
The district prosecutor's office will continue to take all possible measures to protect the rights and legitimate interests of individuals and economic entities of the district regarding received appeals.
