"A strong President, an influential parliament..." The legal formula is defined in Belarus
On June 28, President of Belarus Alexander Lukashenko signed Decree No. 196, which approved the Concept of Legal Policy. This was reported to BELTA by the press service of the Belarusian leader.
The Concept is a document structured in five chapters, defining the development strategy of the entire legal system of the country, which in modern conditions should not only regulate social relations but also prevent possible challenges and threats.
Within the framework of the concept, the definition of the legal policy of Belarus, its goals, principles, as well as subjects are determined: "Legal policy is a scientifically based activity of the state with the participation of citizens and public institutions in the formation and development of all elements of the legal system."
The document enshrines the national historical and cultural foundations of the legal system and traces its evolutionary path: "Throughout its history, the country has repeatedly
"Today, the Republic of Belarus is a state built on a solid foundation of universal human values, striving for peaceful coexistence, constructive dialogue, and mutually beneficial cooperation with other states and regions, which is reflected in national law," the concept states.
Ideological imperatives, which serve as the foundation of legal policy, are enshrined. State sovereignty and territorial integrity are key. Based on them, the rest are implemented - national security, popular sovereignty, social justice, and others. The constitutional order will be protected, and the interests of citizens will be protected.
The Concept also provides for priority areas for the development of branches of legislation. In the spheres of defense and national security legislation, it is necessary to strengthen the protection of the country's information sovereignty, and to develop supranational standards and rules in the field of information security with an emphasis on promoting national legal interests. In the spheres of civil and economic (business) legislation, the principle of social responsibility of business to the state, society, and citizens is to be implemented. Within the framework of legislation regulating the social sphere, it is necessary to shift the focus of legal regulation from state patronage to establishing partnerships between the state, society, and citizens. Mutually beneficial cooperation should be built, and the responsibility of each citizen for their life, health, and well-being should be increased.
The Concept of Legal Policy maintains the trend towards unification and codification. Codification of legislation in the field of environmental protection and investment legislation is envisaged, as well as systematization of legislation in the field of intellectual property, etc.
In accordance with the concept, legal work will be built according to the formula "a strong President, an influential parliament, an initiative-taking government with the unifying role of the All-Belarusian People's Assembly".
The application of the concept will make it possible to update and direct all legal processes - from the development of legislation to science and education.
