Land plot legalization
In 2022-2023, land inventory was carried out using data from the Geoportal of the Land Information System of the Republic of Belarus.
In the Verkhnedvinsk district, more than 350 cases of unauthorized land occupation were identified.
As of July 1, 2024, only 46 land users have applied for legalization.
In the past, the situation was handled radically: people were obliged to return the land, demolish buildings, and restore order on the illegally occupied plot.
That is, citizens who have installed a fence beyond the boundaries of the allocated plot and/or built something on this site, or cultivated a garden, will be able to legalize the illegally occupied plots. It is important to note – without bringing them to administrative responsibility.
For reference: As of January 1, 2023, the Land Code of the Republic of Belarus entered into force in a new edition. One of the significant changes was the implementation of the so-called "land amnesty" from September 1, 2023, which can be used for three years – until September 1, 2025.
The task of executive committees is not just to bring order to land use, but to help citizens understand the situation and legalize the actual land situation.
Therefore, we urge you: if you know that you have violations on your land plot, do not wait until August 2025, but come now, while there is an opportunity to consider your legalization application in a calm environment.
Legalization of an illegally occupied land plot is carried out by paying a fee for the right to legalization. For example, in Verkhnedvinsk, on Sovetskaya Street, a plot of 0.01 hectares has been illegally occupied. When legalizing this plot, a citizen will need to pay a fee for the right to legalization in the amount of 519 to 760 rubles, depending on its location;
in Borovka village, on Moskovskaya Street – 232 rubles;
in Osveya town, on Lenina Street – 210 rubles,
in Borkovichi agro-town – 118 rubles,
in Bigosovo agro-town – from 48 to 60 rubles.
When legalizing illegally occupied land plots, citizens will need to pay, in the prescribed manner, for the procedure of re-registering the main land plot, which will cost about 400 rubles.
Therefore, if you have a plot of land in use that contains a garage or outbuilding, and you do not have a land title document, you must submit a corresponding application to the rural executive committees or the district executive committee at the location of the land plots for their registration, or take all necessary measures for the demolition of structures and fences by August 31, 2025. This will be your opportunity to adapt your desires to the new reality.
Otherwise, after September 1, 2025, the executive committees will be obliged to make a decision on the demolition of the illegal structure and the return of the land to its rightful owner without compensation for the costs incurred during the period of illegal use. The land plot will be restored to a condition suitable for its intended use at the expense of the person who illegally occupied it, through court proceedings.
