Is it necessary to obtain industrial safety permits for the operation of a trampoline complex?

The lists of hazardous production facilities and potentially hazardous facilities subject to state supervision in the field of industrial safety are established by Annexes 1 and 2 to the Law of the Republic of Belarus of January 5, 2016 "On Industrial Safety".

Trampoline complexes and trampolines are not included in the specified lists and are not subject to state control (supervision) in the field of industrial safety and registration with Gospromnadzor. Consequently, industrial safety permits (special permits (licenses), permits from Gospromnadzor) for the operation of the specified equipment are not required.

Additionally, we inform you that on April 18, 2018, the technical regulation of the Eurasian Economic Union "On the Safety of Amusement Rides" (TR EAEU 038/2016), adopted by the decision of the Council of the Eurasian Economic Commission of October 18, 2016 No. 114 (hereinafter referred to as TR EAEU 038/2016), entered into force. According to this regulation, the release of non-mechanized amusement rides (trampolines) into circulation on the market of the Eurasian Economic Union, including on the territory of the Republic of Belarus, after April 18, 2018, is possible provided that conformity assessment is carried out in accordance with Section XI of TR EAEU 038/2016.

Question 2:

I am opening an individual entrepreneurship and plan to operate an inflatable slide. What permits do I need and where should I obtain them?

In accordance with the Regulation on the Department for Supervision of Safe Industrial Operations of the Ministry of Emergency Situations of the Republic of Belarus, approved by Decree of the President of the Republic of Belarus of November 14, 2022 No. 405, Gospromnadzor exercises state supervision in the field of industrial safety over hazardous production facilities and (or) potentially hazardous facilities, and related activities.

The lists of hazardous production and potentially hazardous facilities are indicated in Appendices 1 and 2 to the Law of the Republic of Belarus "On Industrial Safety" of January 5, 2016 (hereinafter referred to as the Law).

In the event that the inflatable slide indicated in the request, according to the operational documents, is classified as a water slide with a linear speed of passenger movement exceeding 5 m/s and/or a relative drop height exceeding 3 meters, then in accordance with paragraph 6 of Annex 2 to the Law, it is considered a potentially hazardous object, subject to state supervision in the field of industrial safety, and its operation must be carried out in accordance with the requirements of the Law and the Rules for ensuring the industrial safety of amusement rides, approved by the Resolution of the Ministry of Emergency Situations of the Republic of Belarus dated 13.10.2009 No. 52.

In the event that the inflatable slide is classified as inflatable play equipment (hereinafter referred to as equipment), we inform you that the equipment is not included in the aforementioned lists, is not subject to state supervision in the field of industrial safety, and the State Industrial Supervision Service is not authorized to issue permits related to its operation.

We further inform you that, as of 01.04.2023, the Rules for ensuring technical safety "Requirements for the operation of inflatable play equipment, inflatable amusement rides," approved by the Resolution of the Ministry of Emergency Situations of the Republic of Belarus dated 17.11.2022 No. 64 (hereinafter referred to as the Rules), are in effect for equipment operated in the Republic of Belarus.

In accordance with the requirements of the Rules, the operation of equipment covered by the Rules is permitted if it has operational documents for it, which, according to paragraph 6 of the Rules, include a passport (form) and an operating manual.

Requirements for the safe operation of equipment, as well as the list of necessary logs and instructions, are specified in Chapters 3 and 4 of the Rules.

In accordance with Chapter 5 of the Rules, the equipment must undergo technical inspections throughout its entire service life, with the issuance of a corresponding certificate, which is attached to the operating documents and is an integral part thereof.

In accordance with clause 65 of the Rules, the technical inspection is carried out by an organization accredited in accordance with the requirements of the interstate standard GOST ISO/IEC 17020-2013 "Conformity assessment. Requirements for the operation of various types of bodies performing inspection," approved by the Resolution of the State Committee for Standardization of the Republic of Belarus dated August 30, 2013 No. 45.

Currently, information about entities that have undergone the accreditation procedure in accordance with the aforementioned requirements and are authorized to conduct technical inspections of equipment can be obtained on the website of the Belarusian Accreditation Center.
