Disobedience to a lawful demand

The Verkhnedvinsk Inter-district Inspectorate for the Protection of Fauna and Flora hereby informs that, in accordance with the Regulation on the State Inspectorate for the Protection of Fauna and Flora under the President of the Republic of Belarus, approved by Decree of the President of the Republic of Belarus of July 15, 2019 No. 269.

Officials of the State Inspectorate, within their competence and in compliance with the requirements established by law, have the right to:

inspect territories, premises, and other possible places of storage of tools and means for obtaining natural resources, as well as the natural resources themselves and relevant documents;

use technical means, including equipment for sound and video recording, photography, xerocopying, document scanners, and hidden image identifiers;

verify identity documents and documents confirming authority from representatives of the audited entity;

verify documents for the right to use objects of fauna and flora, lands, forest fund, to carry out fishing and hunting, to conduct fishing and hunting management, to carry out activities for the reproduction and protection of the forest fund, as well as identity documents of citizens, if there is information indicating that they have committed crimes or administrative offenses;

during control measures, stop vehicles and floating means, vessels, conduct searches of belongings, vehicles and floating means, vessels, tools and means used to affect natural resources, and other items, as well as personal searches of citizens;

request and receive, in accordance with the law, written and oral explanations from employees of state bodies, other legal entities, and other citizens within the established timeframe, as well as necessary documents (their copies), including in electronic form, and other information on issues arising during control measures or necessary for their conduct;

carry out the placement, including short-term, within the boundaries of water protection zones or coastal strips of movable property (vessels, vehicles, and others) without оформление of title and permit documents for land plots (territories) within which control measures are carried out;

to seize the tools and means used to affect natural resources, transport and floating means, vessels, natural resources, items that bear traces of crimes or administrative offenses, as well as relevant documents, to demand immediate surrender (laying down) of weapons;

to deliver persons who have committed administrative offenses, for which protocols are drawn up by authorized officials of the State Inspectorate, to internal affairs bodies for identification;

to seek clarification on emerging issues from employees of state bodies, other legal entities;

during field activities, to freely visit at any time of day the facilities of legal entities and individual entrepreneurs upon presentation of an official ID, and facilities with restricted access in accordance with the law – upon presentation of other documents provided for by law for access to these facilities;

to temporarily restrict or prohibit the movement of citizens, as well as their access to certain areas of land and facilities, to oblige them to leave a specific place for conducting procedural actions, ensuring the preservation of evidence or checking documents;

Officials of the State Inspectorate, while performing their official duties, are representatives of state power and are under state protection.

Any influence in any form on the specified officials that hinders the performance of their official duties, or interference in their activities is prohibited.

Liability for disobedience to a lawful order or demand of an official of a state body while performing his official powers by a person not subordinate to him in service in accordance with Article 24.3 of the Code of Administrative Offenses of the Republic of Belarus entails the imposition of a fine in the amount of two to one hundred base units, or community service, or administrative arrest.
